Legal Custody and Physical Custody
In California, there are two components to child custody: legal custody and physical custody. A grant of legal custody allows you to participate in important decisions in your child's life, such as health care, schooling and religious training. A grant of physical custody means that the minor child will have your home as his or her principal residence. When determining custody and visitation, the courts will always give priority to what is in the best interests of the children.
At our office, we help men and women establish and implement temporary custody and visitation orders pending the finalization of a divorce. We also handle permanent custody orders and requests for modification of existing orders, when circumstances change or parents move away. To learn more about this area of our practice, see our page on modifications and move-aways .
We also work to develop visitation arrangements that are in the best interests of the children while protecting your rights as parents. We will also assist grandparents who seek visitation.
We maintain an extensive network of counseling services to assist individuals and families as they work through the challenges and conflicts that can accompany divorce, custody and visitation issues. We often proactively refer clients to counseling if this may be an issue or requirement in the final court order. We have resources that can assist clients with:
- Parenting classes
- Reunification counseling
- Age-specific issues for parents of minors
- Individual counseling for minors
- Counseling to deal with conflicts in co-parenting
- Counseling to address separation challenges between parent and child
- Counseling to address parent-child conflicts
